On Tuesday night, the New Castle Town Board opened its public hearing for people to weigh in on a proposed “model” ordinance, which would allow for a series of changes to land use and zoning to incorporate terms of Westchester County’s housing settlement with the Anti-Discrimination Center. Overview of the mandate:
Under the terms of the 2009 agreement, the county must build at least 750 “fair and affordable” (AFFH) housing units over a seven-year period. In order for the units to count,they must be built within 31 municipalities , including New Castle, that have a relatively lower percentage of racial minorities. AFFH units will be built by developers for either rental or sale, and they must be aggressively marketed to people who are “least likely to apply,” which can mean minority groups.
What are the income qualifications?
Eligible people who qualify for AFFH rental units can have up to 60 percent of the area’s average median income (AMI), a number calculated by the U.S. Department of Housing and Urban Development (HUD). Rental costs must not exceed 30 percent of that 60-percent AMI maximum.
People who are eligible to buy AFFH housing units can have up to 80 percent AMI. Ownership costs cannot exceed 33 percent of that AMI cap.
The specific dollar amounts that align with the AMI percentages are determined by HUD.

Under New Castle’s model ordinance, preferences are being eliminated for previously targeted groups for other affordable housing iterations, such as residents and area employees. Under the terms of the county’s settlement, while the goal is to increase racial diversity, there is no set quota, and people of any race and ethnicity who meet the income range can qualify.
How long do AFFH units keep their designation?
AFFH units must be restricted, including limits on rental and sales changes, for at least 50 years through special covenants. These units must also be the primary residences of their occupants.
